Brazil Appoints New Head of Gambling Regulator

The appointment of Duda as the head of the Secretariat for Prizes and Lotteries (SPA) was officially announced. The Brazilian government’s Chief of Staff, Rui Costa, signed the appointment, which was published in the official government journal. Duda’s role will be to oversee the regulation of gambling in Brazil. He previously worked in the legal and regulatory sectors, serving as the legal director of the National Association of Rail Transport (ANTF). He has a close connection with the Executive Secretary of the Brazilian Ministry of Finance, Dario Durigan, with whom he worked during Dilma Rousseff’s time in office.

The SPA, a branch of the Ministry of Finance, is responsible for establishing the regulatory framework and issuing guidelines for the gambling industry. The agency had been without a leader, with Simone Vincenti serving as the deputy secretary.

Duda’s new position will oversee the regulation of gambling in Brazil. The country is currently regulating the gambling market after President Luiz InĂ¡cio Lula da Silva signed Law No. 3626/2023 in December.

Over the last seven days, the Brazilian Treasury Department and the Lottery Oversight Agency have issued fresh guidelines concerning wagering, specifically Normative Decree Number 615. These new rules include a provision that operators are not allowed to accept wagers via credit cards or digital currencies.

Brazil is currently implementing regulation in four stages, anticipated to be finalized by the end of July 2024. The initial stage, presently in progress, concentrates on establishing payment, security, and technical frameworks.

The second stage will involve the Lottery Oversight Agency releasing its policy on fraud, encompassing anti-money laundering and anti-terrorism financing strategies. The third stage will focus on advertising procedures, as well as technical and security aspects. Lastly, the final stage will concentrate on how the industry can contribute to social responsibility initiatives.

The Treasury Department will oversee sports betting advertising.
Earlier this year in April, Brazil also declared that sports betting advertising must adhere to the Treasury Department’s regulations.

The Brazilian Football Confederation (CBF) General Competition Rules for 2024 stipulate that advertising must comply with guidelines, such as prohibiting unauthorized operators from advertising.

Unfounded claims related to winning probabilities in advertising are also prohibited, as well as marketing that promotes gambling as a solution to financial difficulties or as a socially acceptable leisure activity.

It is also forbidden for workers in the gambling industry to utilize famous people or other prominent figures to advertise their products.
